Policy

These are my standard terms of service for any creative project. I have a "Full Transparency Policy" with clients. You, the client, will be my creative partner from start to finish.The process goes as the following:

1. Sketching Phase ✏️

I will sketch out a few concepts on good ol' pencil and paper and then send it over to you to look over via your choice of contact. We decide on the creative direction and adjustments here.Rough quotes will be given if requested.

2. Digital Drafting 🖥️

The design will be transferred to the computer after the sketch has been approved. A draft with watermarks will be sent over their choice of contact or seen on stream*.The client can make minor color adjustments. If changes exceed beyond this e.g., pose/layout change, a $75 fee will be incurred as this will take extra time.

3. Final Proof 🖼️

Once the client finalizes the design, I will send the finished product over along with the invoice for payment. Depending on the project, the following will be sent as:

* I do art streams on Twitch to teach those who'd like to pursue design. I will always ask if the client is okay with me doing so and will respect their wishes. While it's easier when the client is in the chat so they can give direct feedback during step 2, it's not absolutely necessary.

Terms of
Service (TOS)

Any requests containing nudity, racism, pedophilia, homophobia, transphobia, white/racial supremacy, fetishes, sexism, ableism, gore, anthro/furries and/or any kind of harassment theme(s) will automatically ignored and rejected.No exceptions.

If you commission me to create emotes for you with the intention of having it being animated by someone else, please let me know ahead of time of said intention and what format you would like the layers to be in; I would like to make the animator's job as simple as I can.Commercial Usage
All commissions are for your personal use only, unless otherwise agreed upon through contract. Commercial use (i.e. t-shirts, pins, stickers, etc.) of any of my art must be discussed prior to such use. A commercial license fee will be incurred in the invoice and will vary depending on the size of the project. All characters drawn are assumed and believed to belong to their respective owners unless told otherwise.Ownership and Copyright
All original preparation materials, sketches, visuals and unused ideas shown and considered will remain the property of ichimotes.I am free to use unused and previous ideas for future conceptual and client work. A previously unused idea/design may retain a similar look and style to the finished design, I shall repurpose and style it so the end design is sufficiently different as to not cause conflict.I reserve the right to show any artwork, ideas, sketches created for your project in a portfolio as work samples. If there are specific secret or NDA requirements, please let me know before agreeing to the project proposal.Even if the final payment is NOT received as agreed, all designs and concepts remain the property of ichimotes.You are free to change, modify and adapt the finished design as you see fit, but you do so at your own risk.

No Communication 🔇

If the client is non-responsive after two (2) weeks upon hiring me for a project with one (1) follow up response from me via email and/or direct messages, I will consider our contract terminated.The 50% project deposit will be kept and is nonrefundable.

Payment 💵

All payments are final and nonrefundable.All prices are in USD and payment is completed via PayPal.I reserve the right to request a 50% of payment prior to starting your project, regardless of the size.An invoice will be sent to you via email. Please do not send any money/remaining balance until we are both in agreement. By remitting deposit funds you are accepting these Terms of Service and entering a contract with ichimotes.Rushed commissions can be done at extra cost and can vary depending on the project scope.I will invoice for the remaining cost of the project and associated services prior to the release of any design files or final exports. I reserve the right to withhold delivery until payment has been received in full.I reserve the right to invoice prior to the time detailed if you have been uncontactable/unresponsive for more than 30 days.You reserve the right to request a payment plan which may be accepted at my discretion. All payment plans must be agreed to both parties in writing.All payments are to be made within 30 days of issue.I reserve the right to charge you for any fees incurred relating to commencement of collection and recovery processes for accounts that remain unpaid in excess of 30 days.

Kill Fee ☠️

If the client and I cannot move past the sketching phase, a kill fee of 25% of the agreed price for the project will be incurred.The client will have one (1) week to pay unless a payment plan has been discussed prior.You will not be charged if I decide to cancel your commission on my own accord. You will receive a full refund if you have already paid for your commission.
